Three acquitted of rape Fairs 
Three young men accused of the gang rape last summer was acquitted today by the district court. 
A 17-year-old girl had followed the men to a wooded area in Älvsjö south of Stockholm. Where she was invited to hashish and began to feel ill.

According to the indictment, the woman FEMALE MINOR then pushed and beaten and sexually abused by two male peers. In questioning the girl said that she was shocked and at times did not understand what happened.

The two 17 year old boys were charged with aggravated rape. A 18-year-old man was charged with complicity. All three have been in custody since September, but now freed by Södertörn District Court.

In its judgment, the court writes inter alia that it is unclear who has done what and to what extent coercion has occurred. [Comment:  if ANY coercion has occurred, it is unlawful.]

The District Court also considers that the girl was not so affected "that she was in a particularly vulnerable situation". [Not so affected?  Are you kidding me?  A minor that was given hashish before being violently sexually assaulted in a secluded area by 3 males she was in no position to challenge physically?]

- The new law on "particularly vulnerable" never tested in the judgment. The reason is that the court frees the accused arguing that the prosecution evidence about the event itself does not hold, says Metro's legal expert Stefan Wahlberg, who read the verdict.

- When it comes to one of the freed men so consider the district court did not even consider it proved that he was at the scene. As for the other two so consider the district court that it is not proven that they truly acted as the prosecution claims, he says.  [So she raped herself?]

A 19-year old man is still suspected of aggravated rape and aiding and abetting, but he has because of his mental condition has not yet been prosecuted.

The law was tightened July 1

On July 1 this year tightened the rape law and the concept of "particularly vulnerable" was introduced, which can mean sleep, illness or severe intoxication. Previously was that the victim was "put in a helpless state" to offense would be classified as rape.

Three young men freed by Södertörn District Court for an alleged gang rape.

According to the District Court, there were some ambiguities in the plaintiff's stories that made the suspects could be sentenced.

- I think it is a wrong judgment. I had hoped that they would be felled, says the counsel Anna Dahlbäck

The incident occurred on the evening of 29 August [2013] this year in a wooded area between Älvsjö and Solberga, south of Stockholm. A 18-year-old man and two 17 year old were charged.

According to the indictment was the abused woman affected [by drugs] when the perpetrators molested her.

- They have done it by force or coercion and by utilizing the plaintiff with respect to several different circumstances found themselves in a particularly vulnerable situation, have to prosecutor Mathias Lidberg earlier told the Expressen reporter Fredrik Lennander.

"Proper assessment of the evidence"

The three young men were acquitted of all charges.

- In my opinion it was a real assessment of the evidence, there was weak evidence, said lawyer Richard Schönmeyr, representing one of the suspects.

The legal counsel Anna Dahlbäck says she was surprised that all three were acquitted.

- It would have been extremely important to get a conviction for redress, and an acknowledgment that you believe in her. I assume that it will be appealed, she says.

Prosecutor Mathias Lidberg
has not yet decided whether he will appeal. He does not share the District Court's view that there were ambiguities in the plaintiff's story.

- I believe that she has made a credible story and that it has found support in the evidence, he says.

New law

The suspected gang rape took place after the law was amended on 1 July this year. When was the expression "helpless state" and replaced with "particularly vulnerable position".

According to the Government to legislative changes mean that more cases of sexual abuse will be punishable as rape. For instance, situations where the victim has faced the assault of inaction due to fear or intoxication could be judged as rape.

What a "particularly vulnerable position" covers are not yet developed in practice. Prosecutor Mathias Lidberg chose to hear the case, as one of the very first with the new law. He claims that the young woman was so scared and shocked that she was not able to defend himself or to scream for help.

- I mean this is attributable to that she has been in a particularly vulnerable situation, he has previously said.

Three young men were charged today [in relation to gang rape of] a young woman in Stockholm last summer.

The suspects have been detained for several months - two of them are minors and prosecuted now for aggravated rape.

- I consider rape as aggravated because there are several people who have abused the plaintiff, said prosecutor Mathias Lidberg.

Detention time

The indictment accused two underage boys for aggravated rape, or attempted rape and sexual molestation. The third person is over 18 years and prosecuted for complicity in aggravated rape, alternatively, complicity to attempted aggravated rape and sexual molestation.

Two of the suspects have been detained since the beginning of September and the third was arrested in early October.

According to the indictment, it should also have been a fourth person involved in the rape.

Although he has been detained on suspicion of the crime but was released on Wednesday. He is still suspicious but his mental state means that the prosecutor believes that it is inappropriate to prosecute him now.  [What about the suicidal rape victim's state?]
Took turns

According to prosecutor Mathias Lidberg based prosecution largely on the woman's information.

The trial will begin on 3 December and is expected to last six days.

A 20-year-old man convicted of the gang rape at Älvsjö last summer is appealing to the Supreme Court.

Four young men were suspected of a rape in a wooded area in Fairfield last summer, but only the now 20-year-old man has been convicted in the District Court and Court of Appeal.

Now he complains to the Supreme Court, arguing that the girl voluntarily had sex with him.

The appeal also calls into question the reliability of the victim because she was under the influence of drugs.

- It is a comprehensive investigation material that the court had to decide. Three Somali teenagers indicted today for rape and abetting aggravated rape which they committed on August 29 this year. The fourth Muslim rapist was released from custody yesterday, the three others remain. His mental condition does not allow for the prosecution of him in the present. He is still suspicious. Poor thing, a small poor unaccompanied Muslim ... not prosecuted, but that gruppvåldta a defenseless little girl he manages by. A true cosseting so you feel sick.

The trial will begin on 3 December and is expected to last six days.

There's also one mystery accused.

Everybody's been let off, of course.  I'm beginning to think that this is pretty standard in Sweden.

Definitely doesn't sound right to me.
